Terms of Use
Last updated: 23 July 2026
Welcome to Makesake Books. We’re excited to help you create something your family can treasure for years to come.
These Terms explain how Makesake Books works, what you can expect from us, and what we ask of you when using our website or ordering one of our personalised books.
We’ve written them in plain English because we think legal documents should be understandable. While we’ve kept the language simple, these Terms are still legally binding, so please take a few minutes to read them.
If you have any questions, we’d much rather answer them than hide behind legal jargon. Just email us at stories@makesakebooks.com.
1. Who we are
Makesake Books is an Australian business that creates personalised children’s books using a combination of artificial intelligence, automation and carefully designed creative processes.
Every story and every illustration is generated specifically for the child you’ve created the book for. No two books are exactly alike.
Our website is located at www.makesakebooks.com.
Throughout these Terms, “Makesake Books”, “we”, “our” and “us” all refer to the operator of this website. “You” means the person using the website or placing an order.
2. Accepting these Terms
By using our website, creating a preview, placing an order or uploading any information, you agree to these Terms.
If you don’t agree with them, that’s completely okay — but you shouldn’t use Makesake Books or place an order.
These Terms apply together with our:
- Privacy Policy
- How We Use AI page
- Cookie Policy (where applicable)
Together, these documents explain how Makesake Books operates. If there’s ever an inconsistency between these documents, these Terms take priority unless Australian law says otherwise.
3. Who can use Makesake Books
Makesake Books is designed for adults creating personalised books for children. To place an order you must:
- be at least 18 years old;
- be legally able to enter into a contract;
- provide accurate information; and
- have the authority to provide any names, photographs, drawings or other content you upload, including the consent of the child’s parent or guardian if that isn’t you.
We don’t knowingly provide our services directly to children.
4. Definitions
Some words appear throughout these Terms. Here’s what they mean.
Book
A personalised digital or printed story created by Makesake Books. A Book may include text, illustrations, uploaded drawings, photographs, dedication messages and other personalised content.
Preview
A free sample of your personalised story that lets you see the quality before purchasing. A Preview isn’t the complete book and may differ slightly from the final version, since additional pages and illustrations are generated afterwards.
Personal Information
Information you provide that identifies, or could reasonably identify, a person — for example names, photographs, drawings, hometown, appearance, dedication messages, interests, or companion character names.
Uploaded Content
Anything you choose to upload or provide to Makesake Books, including photographs, drawings, names, written messages, or any other content submitted while creating a book.
AI Providers
The technology companies that help generate parts of your book. At the time these Terms were last updated, these include Anthropic (Claude) and Google (Gemini). We may change technology providers in the future if we believe another provider offers better quality, safety or reliability. If we do, we’ll update our Privacy Policy and How We Use AI page.
Printed Book
A professionally printed physical copy of your personalised book, produced on demand after payment has been received.
Digital Book
A downloadable PDF version of your personalised book, delivered by email.
5. Changes to these Terms
From time to time we may update these Terms to reflect changes to Australian law, our technology, the way Makesake Books operates, our suppliers, new products or services, or improvements we make to the website.
Whenever we make significant changes, we’ll update the “Last updated” date at the top of this page. The Terms that applied when you placed your order will continue to apply to that order.
If you continue using Makesake Books after new Terms are published, you agree to the updated version.
6. Placing an order
When you place an order, you’re making an offer to buy a Book on these Terms. We accept that offer once we confirm your order and receive payment in full.
All prices are shown in Australian dollars and include GST where applicable.
We may decline or cancel an order at our discretion — for example, if we reasonably suspect fraud, if the Uploaded Content breaches these Terms, or if we’re unable to produce the Book as requested. If we cancel an order you’ve already paid for, we’ll refund you in full.
7. Previews
Before you buy, we’ll generate a free Preview so you can see the style and quality of your Book. A Preview is a sample, not the finished product — the final Book may include additional pages, refinements, or minor differences in illustration as the full story is generated.
8. Payment
Payment is processed securely through our third-party payment provider. We don’t store your full card details ourselves. Full payment is required before we begin producing your final Book.
9. Delivery
Digital Books
Digital Books are emailed to you as a PDF, generally within a few business days of your final approval, though this can vary depending on demand.
Printed Books
Printed Books are produced on demand after payment and go to print once approved. Delivery timeframes we provide are estimates only, since they depend on our printing partners and Australia Post or our chosen courier. We’ll do our best to help resolve any issues with lost or delayed parcels, but we’re not responsible for delays caused by the postal service once a Book has been dispatched.
Damaged or faulty Books
If your Printed Book arrives damaged or with a manufacturing fault, contact us at stories@makesakebooks.com with photos and we’ll arrange a replacement or refund in line with your rights under the Australian Consumer Law.
10. Your content and what you upload
When you upload a photo, drawing, or other content, you confirm that:
- you own the content or have the right to use and share it;
- if the content features a child who isn’t you, you have the authority of that child’s parent or guardian to upload it and use it to create a Book; and
- the content doesn’t infringe anyone else’s rights.
You grant us a licence to use your Uploaded Content solely for the purpose of creating, producing, and delivering your Book, and for the limited purposes described in our Privacy Policy.
You must not upload content that is unlawful, abusive, infringes someone else’s intellectual property, or is otherwise inappropriate. We may refuse to process, or may remove, any content that breaches this.
11. Intellectual property
The Makesake Books name, logo, website, story templates, and illustration style are owned by us and protected by copyright and trade mark law.
Once you purchase a Book, you receive a personal, non-commercial licence to use, print, and share that Book with family and friends. You may not resell, mass-reproduce, publish, or use your Book or its illustrations for commercial purposes without our prior written permission.
12. AI-generated content
Books are created with the help of artificial intelligence. Because AI-generated content is created fresh for every order, there can occasionally be small variations or inconsistencies — for example, in how a character’s features are rendered from one page to the next.
We review each Book for quality and appropriateness before it’s sent to you, but we can’t guarantee that every element will be flawless every time. See our How We Use AI page for more detail on how this works.
13. Refunds and cancellations
Because each Book is personalised and produced specifically for you, we’re generally unable to offer a change-of-mind refund once you’ve approved a Preview and payment has been made.
This doesn’t affect your rights under the Australian Consumer Law. If a Book has a major failure — for example, it’s significantly different from what was described, or arrives faulty — you’re entitled to a repair, replacement, or refund as required by law. Nothing in these Terms excludes, restricts, or modifies those consumer guarantee rights.
14. Limitation of liability
To the maximum extent permitted by law, our liability to you for any claim arising from these Terms or your use of Makesake Books is limited to the amount you paid for the relevant Book.
We’re not liable for indirect or consequential loss, such as loss of enjoyment or disappointment, except where the law doesn’t allow that exclusion. Nothing in this section limits any guarantee, right, or remedy you have under the Australian Consumer Law that can’t lawfully be excluded.
15. Acceptable use of our website
When using our website, you agree not to:
- attempt to gain unauthorised access to our systems;
- scrape, copy, or reuse our content or illustration style for another product or service;
- upload content that is harmful, unlawful, or that you don’t have the right to share; or
- interfere with the proper working of the website.
16. Third-party services
Our website may link to or rely on third-party services, including payment processors, printing partners, and AI Providers. We aren’t responsible for the content or practices of those third parties beyond our arrangements with them, though we choose our partners carefully.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
18. Contact us
If anything in these Terms is unclear, or you’d just like to talk to a person, email us at stories@makesakebooks.com. We’d much rather answer your question directly than have you guess.
